Ever wonder if when you “find” an item while fighting someone wether or not they actually lose that item you “stole”? This question has been buggin me for some time now, and i just got the answer while fighting!

This is a test winning one of these dudes - Bodyguards

So it would seem that there is a chance to loot any item from anyone, and if you find something, they DO NOT lose it from their inventory.
